By accessing or using the website at middletownconcretecompany.com, requesting a quote, or engaging Middletown Concrete Company ("we," "us," or "our") to perform any services, you agree to be bound by these terms and conditions. If you do not agree, please do not use our website or services. These terms apply to all visitors, clients, and others who interact with our website or services.
Middletown Concrete Company provides concrete contracting services to residential and commercial customers in Middletown, CT and surrounding communities. Services include, but are not limited to, concrete driveway installation, patio construction, sidewalk building, stamped concrete, garage floors, retaining walls, foundations, footings, steps, pool decks, parking lots, and concrete cutting.
All services are subject to availability, site conditions, required permits, and the terms of a written estimate or contract signed by both parties. We reserve the right to decline or limit services based on project scope, location, or other factors at our sole discretion.
All estimates provided by Middletown Concrete Company are based on information available at the time of the on-site visit or initial consultation. Estimates are not binding contracts. A written proposal or contract signed by both parties is required before work begins.
Prices may change if site conditions differ materially from what was observed during the estimate, if the scope of work changes at your request, if unforeseen conditions are discovered during the project (such as root intrusion, subsurface drainage issues, or unstable soils), or if the cost of materials increases between the estimate date and the project start date.
We will notify you of any price changes before proceeding. You have the right to decline additional work at the revised price, and we will stop work at that point.
Project scheduling is subject to crew availability, permit timelines, and weather conditions. Concrete work cannot be performed safely in temperatures below approximately 40 degrees Fahrenheit or during active precipitation. We will notify you of any weather-related delays as promptly as possible and will reschedule at no penalty.
If you need to cancel or postpone a scheduled project, please contact us as soon as possible. Cancellations made with less than 48 hours notice after a start date is confirmed may result in a cancellation fee to cover crew scheduling costs. The specific fee, if any, will be stated in your written contract.
Middletown Concrete Company reserves the right to cancel or reschedule projects due to circumstances beyond our control, including but not limited to severe weather, material shortages, permit delays, or crew illness.
Payment terms will be specified in your written estimate or contract. In general, we require a deposit prior to project commencement and final payment upon satisfactory completion of the work. Specific deposit amounts and payment schedules are agreed upon in writing before work begins.
Accepted payment methods are stated in your written contract. Payments not received by the agreed due date may be subject to a late fee as specified in the contract.
Ownership of all materials installed on your property transfers to you upon receipt of final payment. We reserve the right to place a mechanic's lien on the property for unpaid balances as permitted under Connecticut law.
Before work begins, you agree to:
We are not responsible for damage to unmarked or undisclosed underground utilities or structures. You are responsible for calling 811 (CT DEEP Underground Damage Prevention) or ensuring utilities are marked before work begins.
Where required by local ordinance, Middletown Concrete Company will obtain the necessary building permits on your behalf. Permit fees are the responsibility of the client and will be included in the project estimate. We will not begin work requiring a permit before that permit is issued. Inspections required by the permitting authority will be scheduled and managed by us as part of the project.
Middletown Concrete Company warrants that all work will be performed in a workmanlike manner and in accordance with the specifications set out in the written contract. Any warranty terms, including duration and coverage, will be stated in your written contract.
The following conditions are not covered under any workmanship warranty:
Manufacturer warranties on materials, where applicable, are passed through to the client.
To the fullest extent permitted by applicable law, Middletown Concrete Company shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to our services or your use of our website - including but not limited to loss of income, loss of use of property, or cost of substitute services - even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of a project shall not exceed the total amount paid by you to us for that specific project.

If negotiation does not resolve the issue within 30 days, either party may seek mediation through a mutually agreed mediator before pursuing any other legal remedy.
Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction where necessary to prevent immediate harm.
These terms and conditions and any dispute arising out of them are governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law provisions. Any legal action arising out of these terms shall be brought in the state or federal courts located in Connecticut, and you consent to the personal jurisdiction of those courts.
